How much notice must landlord give before eviction?
Short answer
Minimum 15 days for month-to-month tenancy under TPA Section 106. Lease agreements may specify longer periods. State Rent Control Acts may require 1-6 months.
Understanding the issue
The notice period for eviction depends on the type of tenancy and applicable laws. Under the Transfer of Property Act Section 106, a 15-day notice is required for month-to-month tenancies. However, if you have a written lease agreement, the notice period specified in the agreement applies. State Rent Control Acts often provide additional protections with longer notice periods ranging from 1 to 6 months. Even after the notice period expires, the landlord cannot forcibly evict you — they must file an eviction suit in court. The notice must be in writing and must specify the grounds for eviction as per the applicable Rent Control Act.
Laws that apply
