Can employer force me to resign?
Short answer
No. Forced resignation is constructive dismissal and is illegal. If pressured, do not sign anything. Document the pressure and file complaint with Labour Commissioner.
Understanding the issue
An employer cannot force you to resign. If an employer pressures you through threats, harassment, demotion, or creating a hostile work environment to make you resign, it constitutes constructive dismissal and is treated as illegal termination. If you are being pressured: do not sign any resignation letter; document all instances of pressure (emails, messages, witness names); file a written complaint with HR; if HR does not help, file a complaint with the Labour Commissioner or raise an industrial dispute. You can claim reinstatement, back wages, and compensation. Courts have consistently held that resignations obtained under coercion or undue influence are not voluntary and can be set aside.
