Am I guaranteed minimum wages?

Short answer

Yes. Every employer must pay at least the minimum wage set by the government. This applies to all workers including contractual, temporary, and daily wage workers.

Understanding the issue

The Code on Wages and the Minimum Wages Act mandate that every employer must pay at least the minimum wage fixed by the appropriate government (Central or State). Minimum wages vary by state, type of employment, and skill level. They are revised periodically. Payment below minimum wage is a criminal offence punishable with fine and imprisonment. This protection applies to all categories of workers — permanent, temporary, contractual, daily wage, piece-rate, and even domestic workers in some states. If your employer pays below minimum wage, file a complaint with the Labour Commissioner or approach the Labour Court.
