Can I prepay my loan without penalty?

Short answer

For floating rate home loans, no prepayment penalty is allowed per RBI guidelines. For fixed rate and personal loans, penalty may apply but must be reasonable.

Understanding the issue

The Reserve Bank of India has issued clear guidelines on loan prepayment. For home loans on floating interest rate, banks and housing finance companies cannot charge any prepayment penalty — this applies to both full and partial prepayment. For home loans on fixed interest rate, a reasonable prepayment penalty may be charged as per the loan agreement. For personal loans and other loans, prepayment terms depend on the loan agreement, but charges must be reasonable and clearly disclosed upfront. Under NHB guidelines, housing finance companies also cannot levy prepayment charges on floating rate loans. If you feel the prepayment charges are unreasonable, you can file a complaint with the RBI Ombudsman or the Consumer Forum. Always check your loan agreement for specific prepayment terms before taking the loan.
