What if someone files a false case against me?
Short answer
You can file for quashing of FIR in High Court under BNSS Section 528. You can also file a counter-complaint for filing a false case under BNS Section 248.
Understanding the issue
If a false case has been filed against you, you have several legal remedies. First, you can apply for quashing of the FIR in the High Court under BNSS Section 528 if the allegations do not make out any offence. Second, you can file a counter-complaint under BNS Section 248 (furnishing false information) against the person who filed the false case. Third, you can also file a defamation case under BNS Section 356. Fourth, apply for anticipatory bail to avoid arrest while you fight the false case. Always gather evidence proving the complaint is false — such as alibi proof, contradictory documents, or witness statements.
