Your rights
Can the government discriminate against me?
Short answer
No. Article 14 guarantees equality before law. Article 15 prohibits discrimination based on religion, race, caste, sex, or place of birth.
Understanding the issue
The Constitution of India guarantees the right to equality as a fundamental right. Article 14 ensures equality before the law and equal protection of laws for every person within India's territory. Article 15 specifically prohibits the State from discriminating against any citizen on grounds of religion, race, caste, sex, or place of birth. Article 16 guarantees equality of opportunity in public employment. If any government action, law, or policy discriminates against you on these grounds, you can challenge it in the High Court under Article 226 or the Supreme Court under Article 32. The government can, however, make special provisions for socially and educationally backward classes, SC/ST, and women/children under Articles 15(4) and 15(3).
