Can I file for divorce due to cruelty?
Short answer
Yes. Mental or physical cruelty is a valid ground for divorce under Hindu Marriage Act and other personal laws.
Understanding the issue
Cruelty — both physical and mental — is a recognized ground for divorce under Section 13(1)(ia) of the Hindu Marriage Act and Section 27(1)(d) of the Special Marriage Act. Cruelty includes physical abuse, verbal abuse, dowry harassment, desertion, refusal of conjugal rights, false accusations, constant humiliation, and any conduct that makes it impossible for the spouse to live together. Mental cruelty is assessed based on the totality of circumstances and the impact on the aggrieved spouse's mental health. You can also file for judicial separation first if you want time to reconsider. Courts typically give time for reconciliation before granting divorce.
