Is harming animals illegal in India?
Short answer
Yes. Beating, poisoning, starving, or torturing animals is a punishable offence under the Prevention of Cruelty to Animals Act and IPC/BNS.
Understanding the issue
Under Indian law, harming animals is a criminal offence. The Prevention of Cruelty to Animals Act 1960 (Section 11) makes it illegal to beat, kick, torture, mutilate, poison, starve, or overload any animal. IPC Section 428 and 429 (now BNS Section 325) punish mischief by killing or maiming animals. Punishments include fines ranging from Rs. 10 to Rs. 50 for first offence under PCA Act (up to 5 years imprisonment and fine under BNS Section 325 for serious cases). Any citizen can file a police complaint against animal cruelty. Animal welfare organizations like SPCA and Blue Cross can also take action. Even stray animals are protected by law.
