What happens after an FIR is filed?

Short answer

After FIR registration, police investigate the case, collect evidence, record statements, and submit a charge sheet or closure report to the Magistrate within 60-90 days.

Understanding the issue

Once an FIR is filed, the investigation process begins. The police will assign an Investigating Officer (IO) who will visit the crime scene, collect evidence, record statements of witnesses under BNSS Section 180, and may arrest the accused if necessary. For cognizable offences, police can investigate without Magistrate's permission. The IO must complete investigation within 60 days (if punishment is less than 10 years) or 90 days (if punishment is 10 years or more). After investigation, the IO submits either a charge sheet (if evidence is found) or a closure report (if no evidence). You have the right to get a copy of the FIR free of charge, track your case status, and file a protest petition if you disagree with the closure report. The Magistrate then decides whether to take cognizance of the offence.
