Penalty for Giving or Taking Dowry

Understanding the issue

Both giving and taking dowry is illegal in India. Anyone who gives, takes, or helps in giving or taking dowry can be punished. This includes cash, property, or valuable gifts demanded as a condition for marriage.

Punishment

Minimum 5 years imprisonment and fine of Rs. 15,000 or dowry amount (whichever is more)

Examples

Groom's family demands Rs. 10 lakh and a car as dowry for the wedding. Both families can be prosecuted under this section.

The section as enacted

If any person, after the commencement of this Act, gives or takes or abets the giving or taking of dowry, he shall be punishable with imprisonment for a term which shall not be less than five years, and with fine.
