Sexual Harassment

Any unwelcome sexual behaviour towards a woman — including touching, demanding sexual favours, showing pornography, or making sexual remarks — is sexual harassment. This is a criminal offence separate from workplace harassment under POSH Act.

• A repeatedly makes sexual comments towards B at a public place despite her objection. A is guilty of sexual harassment.

A man committing any of the following acts — physical contact and advances involving unwelcome and explicit sexual overtures, a demand or request for sexual favours, showing pornography against the will of a woman, or making sexually coloured remarks — shall be guilty of sexual harassment.
