Protection Against Arrest and Detention
Understanding the issue
If you are arrested: (1) Police must tell you why, (2) You can call a lawyer, (3) You must be taken to a judge within 24 hours, (4) You cannot be held longer without court permission.
Punishment
Illegal detention can be challenged through habeas corpus
Examples
- If police arrest A but don't produce him before a magistrate within 24 hours, A's Article 22 rights are violated.
