Understanding the issue

Under Indian labour law, employers cannot terminate employees arbitrarily. The Industrial Disputes Act protects workmen from unfair termination — employers with 100+ workers must get government permission before retrenchment. Notice period or pay in lieu is mandatory. Termination during pregnancy, for trade union activity, or as retaliation for complaints is illegal. If terminated wrongfully, you can seek reinstatement and back wages.

When to see a lawyer

Consult a labour lawyer immediately. Do not sign any documents or accept a severance package without legal advice. A lawyer can negotiate better terms or file for reinstatement.
