Harming animals is illegal under the Prevention of Cruelty to Animals Act 1960 and the Indian Penal Code (now BNS). This includes beating, kicking, overloading, torturing, starving, poisoning, mutilating, or killing animals. Both domestic and stray animals are protected. Municipal corporations also have animal welfare duties. Citizens have the right to report animal cruelty to police and animal welfare organizations.
When to see a lawyer
Consult a lawyer if police refuse to file FIR, if the case involves organized animal cruelty (dog fighting, illegal slaughter), or if you need to file a private complaint before the Magistrate.
